Payment processing services for Learnitive are provided by PayPal and Payhip and are subject to the Paypal Agreement, which includes the PayPal Terms of Service. By agreeing to these terms or continuing to operate as a Learnitive customer, you agree to be bound by the PayPal Agreement, as the same may be modified by PayPal from time to time. As a condition of Learnitive enabling payment processing services through Stripe, you agree to provide Learnitive accurate and complete information about you and your business, and you authorize Learnitive to share it and transaction information related to your use of the payment processing services provided by PayPal and Payhip.

Learnitive provides a Software as a Service that allows users to create textual content such as summaries, blog articles, etc. Users may sign up and pay for a subscription to access unlimited use of the service. Once a subscription is purchased, it is non-refundable after 14 days unless otherwise determined by Learnitive's support team.

Learnitive's service is available for use and purchase worldwide.

Learnitive provides the Site and the Learnitive Services solely for lawful purposes and in accordance with these Terms of Use. You agree not to use the Site or the Learnitive Services for any illegal or unauthorized purpose.

To access certain features of the Site and the Learnitive Services, you may be required to register with Learnitive and provide certain information about yourself. You represent and warrant that all information you provide to Learnitive is accurate, current, and complete, and you agree to update such information as necessary to maintain its accuracy.

You may be required to pay a subscription fee to access unlimited use of the Learnitive Services. The subscription fee is non-refundable unless otherwise determined by Learnitive's support team. Learnitive uses Payhip and PayPal as its payment processor. By using the Site and the Learnitive Services, you agree to be bound by the PayPal Agreement and the Terms of Service.

All content on the Site, including but not limited to text, graphics, logos, images, and software, is the property of Learnitive or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or display any of the content on the Site without the prior written consent of Learnitive.

The Site and the Learnitive Services are provided "as is" and "as available" without any warranties of any kind, express or implied. Learnitive does not warrant that the Site or the Learnitive Services will be uninterrupted or error-free, nor does it make any warranty as to the results that may be obtained from the use of the Site or the Learnitive Services.

Use of Learnitive must be lawful and in accordance with the terms set out herein. Any use of the platform that violates these Terms of Use, including, without limitation, the following, is expressly prohibited:

a) Unauthorised Automation:

The use of bots, scripts, or any other automated process to interact with Learnitive's services or to automate or accelerate the content generation process is strictly forbidden. Learnitive has been designed to function with human interaction, and attempts to circumvent this requirement are a direct violation of these Terms of Use.

b) Breach of Normal Functionality:

Any action that attempts to disrupt, undermine, manipulate or otherwise interfere with the normal operation of Learnitive's services is prohibited. This includes, but is not limited to, actions that may impose an unreasonable or disproportionately large load on our infrastructure or detrimentally interfere with, intercept, or expropriate any system, data, or information of Learnitive.

c) Penalties for Violation:

In the event of a breach of these rules, Learnitive reserves the right to take any and all appropriate action. This may include, without limitation, restricting or suspending your access to our services, without prior notice. Further, in the case of a violation, no refunds will be issued for any payments made prior to the violation.

Please note that Learnitive reserves the right to investigate and take appropriate legal action against anyone who, in Learnitive's sole discretion, violates this provision, including without limitation, reporting such user violations to law enforcement authorities.

By agreeing to these terms, you accept and acknowledge the conditions set forth in this section and agree to use Learnitive's services responsibly and within the boundaries of these Terms of Use.

Please note that the privileges associated with your Learnitive subscription may be subject to change at any time. In the event of a significant alteration to the terms of your subscription, we will endeavor to notify you via email at least 15 days prior to the change coming into effect. However, please be aware that Learnitive cannot be held responsible if such notifications are not received due to factors beyond our control. This includes, but is not limited to, instances where our emails are mistakenly marked as spam, or if you have unsubscribed or blacklisted our emails. We strongly encourage you to regularly check your spam folder and to maintain an active and accurate email address with us to ensure you receive all necessary notifications.

To the fullest extent permitted by law, Learnitive will not be liable for any damages arising from the use of the Site or the Learnitive Services, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Learnitive may terminate your access to the Site and the Learnitive Services at any time for any reason, including but not limited to a breach of these Terms of Use.

Learnitive may modify these Terms of Use at any time by posting the modified terms on the Site. Your continued use of the Site and the Learnitive Services after such modifications will constitute your acceptance of the modified terms.
